Cancellation & Refund Policy

This Cancellation & Refund Policy explains the terms and conditions for cancelling services and requesting refunds for services provided by Kushal Dhananjay Samant. This policy applies to all services including SaaS subscriptions and custom development projects.


1. Policy Overview

We are committed to fair and transparent cancellation and refund practices. This policy complies with:

  • Consumer Protection Act, 2019 (India)
  • EU Consumer Rights Directive 2011/83/EU
  • FTC Guidelines (United States)
  • Other applicable consumer protection laws

Different cancellation and refund terms apply depending on the type of service. Please review the relevant section below.

2. SaaS Subscription Cancellations

Monthly Subscriptions

Cancellation Process:

  • Cancel anytime via account settings (self-service)
  • Or email writetokushaldsamant@gmail.com
  • Confirmation email sent upon cancellation

Effective Date:

  • Cancellation effective at the end of current billing period
  • You retain access until the end of the paid period

Refunds:

  • No prorated refunds for partial months
  • You've paid for the full month; service remains available until period ends

Auto-Renewal:

  • Automatically stops upon cancellation
  • No further charges after current period expires

Data Export:

  • 30-day window to export your data after cancellation
  • Use account settings or contact support for data export

Reactivation:

  • You may reactivate your subscription at any time
  • Choose same plan or different plan
  • Previous data restored if within 30-day window

Annual Subscriptions

Cancellation Process:

  • Via account settings or email writetokushaldsamant@gmail.com
  • Confirmation email sent

30-Day Money-Back Guarantee:

  • Cancel within 30 days of initial purchase: full refund
  • No questions asked

After 30 Days – Prorated Refund:

  • Prorated refund for unused months
  • Calculation: (Remaining full months ÷ 12) × Annual fee × 90%
  • 10% administrative fee deducted

Example:

  • Annual Plan: ₹12,000
  • Cancelled after 6 months (6 months remaining)
  • Refund: (6 ÷ 12) × ₹12,000 × 90% = ₹5,400

Service Credit Option:

  • Full credit toward other services (no administrative fee)
  • Service credits valid for 12 months

Access:

  • Continues until end of current billing period if no refund requested
  • Immediate termination if refund is processed

Trial Periods

Trial Terms:

  • Duration specified per plan (typically 14-30 days)
  • Full feature access during trial
  • No payment required until trial ends

Cancellation During Trial:

  • Cancel anytime before trial expires
  • No charges applied
  • Automatic cancellation if no payment method added

Auto-Conversion:

  • Trial automatically converts to paid subscription upon expiration
  • Email reminder sent 3 days before conversion
  • Cancel to prevent automatic charge

Post-Trial Cancellation:

  • After trial converts to paid: standard cancellation terms apply

Upgrades & Downgrades

Upgrades:

  • Immediate access to new plan features
  • Prorated charge for remainder of current billing period
  • New price applies on next full billing cycle

Downgrades:

  • Effective at the start of next billing cycle
  • Continue with current plan until period ends
  • No refund for price difference between plans
  • Data and features adjusted on effective date

Add-Ons:

  • Prorated charge when added mid-cycle
  • Cancel anytime
  • Prorated refund for unused portion (monthly add-ons)

3. Development Services Cancellations

Before Project Commencement

Within 7 Days of Payment (Cooling-Off Period):

  • Full refund of deposit
  • No questions asked
  • Request via email: writetokushaldsamant@gmail.com

After 7 Days, Before Project Start:

  • 90% refund of deposit
  • 10% administrative fee applies
  • If discovery/planning work completed: costs deducted from refund

How to Cancel:

  • Email writetokushaldsamant@gmail.com
  • Include: Project name, order number, reason for cancellation
  • Confirmation sent within 24 hours

During Active Development

Client-Initiated Termination:

Notice Required: 30 days' written notice

Payment Due:

  • All completed milestones (100% of milestone fees)
  • In-progress work: Prorated based on percentage completion
  • Third-party costs already incurred (domains, APIs, hosting, licenses)

Deliverables Provided:

  • Source code and files for all paid work
  • Documentation completed to date
  • Transfer of any assets or accounts

Example:

  • Total Project Cost: ₹5,00,000 (5 milestones @ ₹1,00,000 each)
  • Completed: 2 milestones = ₹2,00,000
  • In Progress: Milestone 3, 50% complete = ₹50,000
  • Third-party costs: ₹20,000
  • Amount Due: ₹2,70,000
  • Refundable: ₹2,30,000

Project Suspension:

  • Client may request project pause (maximum 90 days)
  • No additional charges during suspension
  • Resume fee: 10% of remaining project balance
  • Deposit paid holds project slot

Developer-Initiated Termination

For Client Breach:

  • 15-day cure period provided
  • Full payment due for work completed to date
  • No refund of completed work

For Convenience:

  • Rare; only in extraordinary circumstances (e.g., conflict of interest discovered)
  • Full refund of unused deposit
  • Deliverables for all paid work provided
  • Assistance with transition to another provider

After Project Completion

Post-Delivery:

  • No refunds once deliverables have been accepted and delivered
  • Acceptance per Terms of Service (typically 7 days for testing)

Warranty Period:

  • 30-day warranty for defects in deliverables
  • Defect fixes provided free of charge during warranty period
  • Defect: deliverable doesn't meet SOW specifications
  • Does not cover: change requests, enhancements, or new features

Enhancement Requests:

  • Treated as new work with separate quotation
  • Not covered under original project cost

Rejection of Deliverables:

  • Must be based on Statement of Work (SOW) acceptance criteria
  • Specific issues must be documented
  • We have opportunity to revise and correct
  • Dispute resolution per Terms of Service if disagreement persists

4. Refund Processing

Approval Process

Request Submission:

  • Subject: "Refund Request – [Order Number]"
  • Include:
    • Your name and email
    • Order/invoice number
    • Service type
    • Reason for refund request
    • Preferred refund method

Acknowledgment:

  • Confirmation email within 24 hours

Review:

  • Evaluation within 3 business days
  • Approval or denial notification
  • If denied: explanation provided with appeal option

Processing Timeline

Initiation:

  • Approved refunds initiated within 14 business days of approval

Payment Method:

  • Refund to original payment method
  • Credit card: Automatic reversal to original card
  • Bank transfer: To original account

Additional Processing Time:

  • Stripe Processing: 5-10 business days after we initiate refund
  • Bank Processing: 5-7 business days after Stripe processes
  • Total Expected Timeline: 3-4 weeks maximum from request to receipt

Tracking:

  • Refund reference number provided
  • Status updates available upon request

Refund Methods

Original Payment Method (Preferred):

  • Credit/Debit Card: Automatic reversal
  • Bank Transfer: To verified original account
  • Stripe Balance: Credited to Stripe account

Alternative Methods (if original method unavailable):

  • Bank transfer to verified account (requires banking details)
  • Service credits (same value, no expiration)
  • Check/Cheque (for India addresses only, may take longer)

Method Requirements:

  • Identity verification may be required
  • Banking details verification for bank transfers

Refund Confirmation

Notification:

  • Email confirmation when refund is processed
  • Includes: refund amount, method, reference number, expected timeline

5. Non-Refundable Items

The following are not refundable:

Third-Party Costs

  • Domain name registrations
  • SSL certificates
  • Third-party API subscriptions
  • Hosting fees paid to providers
  • Software licenses purchased
  • Stock assets (images, fonts, graphics, etc.)

These costs are passed through to clients and paid directly to vendors. Refunds for these items are subject to third-party vendor policies.

Completed Services

  • Fully delivered development work
  • Accepted project milestones
  • Consumed subscription time (past billing periods)
  • Training sessions attended
  • Consulting hours already used

Administrative Fees

  • Payment processing fees (Stripe, bank charges)
  • Currency conversion fees
  • International wire transfer fees

Late Cancellations

  • Development Services: Cancellations less than 7 days before scheduled start (negotiable based on circumstances)
  • Scheduled deliveries or launches: Past committed deadlines

6. Service Credits

SLA Breach Credits

  • Issued per Terms of Service SLA provisions
  • Calculated based on uptime or support response time failures
  • Applied automatically to next billing cycle

Credit Amounts:

  • Based on severity and duration of service disruption
  • Detailed in Terms of Service, Section 14

Request Process:

  • Must request within 30 days of SLA breach
  • Email writetokushaldsamant@gmail.com with incident details

Credit Terms

  • Validity: 12 months from issue date
  • Application: Automatically applied to subscription renewals
  • Non-Transferable: Cannot transfer to another account
  • Non-Refundable: Cannot be redeemed for cash
  • Combination: Cannot combine with other discounts unless explicitly stated

Credit Balance

  • View current balance in account dashboard
  • Email notification when credits are issued
  • Expiration warnings sent 30 days before expiry

7. Disputed Charges

Contact Us First

Before initiating a chargeback with your bank:

  • Response: Within 48 business hours
  • Resolution Attempt: Within 7 business days

Chargeback Impact

If you initiate a chargeback:

  • Account suspended during investigation
  • Services paused until resolution
  • If chargeback is successful: Account permanently closed
  • If chargeback is reversed: Reactivation may be offered
  • Chargeback fees (if any) may be charged to your account

Dispute Resolution

We will:

  • Review all evidence and documentation
  • Make good faith effort to resolve the issue
  • Follow dispute resolution procedures in Terms of Service
  • Provide clear explanation of charges

8. Currency & Exchange Rates

Transaction Currency

  • Primary: Indian Rupees (INR)
  • International: US Dollars (USD)
  • Prices displayed in your selected currency at time of purchase

Refund Currency

  • Refunds issued in same currency as original payment
  • Exchange rate: Current rate at time of refund processing
  • Exchange rate may differ from rate at time of original purchase
  • Currency conversion risk is customer's responsibility

Fees

  • Bank currency conversion fees: Non-refundable
  • International wire transfer fees: Paid by customer
  • Stripe processing fees: Non-refundable

9. Special Circumstances

Technical Issues

If we experience service issues:

  • Service Unavailable: Prorated refund or service credit
  • Data Loss (Our Fault): Full refund plus compensation
  • Major Bugs: Refund for affected period or resolution at no charge

Service Dissatisfaction

  • We make reasonable efforts to resolve issues and concerns
  • Onboarding support and training offered
  • Mutual termination and refund considered on case-by-case basis

Force Majeure

  • No refunds for delays due to force majeure events (natural disasters, pandemics, war, etc.)
  • Service extension or credits offered instead
  • Per Terms of Service force majeure provisions

Emergency or Hardship

Extraordinary circumstances (medical emergency, natural disaster, etc.):

  • Case-by-case review
  • Payment plans or postponement may be considered

10. Consumer Rights (India)

Consumer Protection Act, 2019

Indian consumers have rights under the Consumer Protection Act, 2019:

11. International Consumer Rights

European Union

Consumer Rights Directive 2011/83/EU:
